Sunset and Audit Legislation Information

Most registration and licensure systems include structural approaches to review both the need and operational effectiveness of the process.

Some states provide formal sunset evaluation processes for their licensure programs. Many also include a periodic audit process of the licensure program/agency, which can range from cursory financial reviews to comprehensive evaluation of program effectiveness.

The audit process is often leveraged when political pressure is applied to eliminate geologist licensure, so awareness of the history and codes for audits and sunset evaluations is critical to montioring the health of the licensure within the state.

Composition of sunset committee: Nine members consisting of three members appointed by the House, three by the Senate and three by the Governor’s Office, the committee will work to ensure that every state agency is a helpful resource to the people of Ohio and a necessary addition to the public.

Audit notes: It does not appear that the Auditor of State audits licensing boards on a regular basis. JCARR does not appear to review audits, but rather, “JCARR’s primary function is to review proposed new, amended, and rescinded rules from over 100 agencies to ensure they do not exceed the rule-making authority granted to them by the General Assembly.”
